1. Acceptance of Terms

By accessing or using ViralPZH ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Proprietary Technology

ViralPZH utilizes proprietary algorithms, trade secrets, and patented technology including but not limited to:

  • Viral Coefficient Optimization Algorithm (VCOA) - Patent Pending
  • Psychological Driver Detection System (PDDS) - Trade Secret
  • Platform-Specific Content Optimization Matrix (PSCOM) - Trade Secret
  • Scroll-Stop Potential Analysis (SSPA) - Patent Pending

These technologies are protected under 17 U.S.C. Section 1201, trade secret law, and international intellectual property treaties.

3. Prohibited Activities

You expressly agree NOT to:

  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the Service
  • Copy, reproduce, or create derivative works based on our algorithms or methods
  • Use the Service to develop competing products or services
  • Scrape, crawl, or use automated means to extract data or analyze our systems
  • Share, license, or transfer access to the Service to third parties for analysis
  • Attempt to identify or extract our proprietary viral scoring methodology
  • Use knowledge gained from the Service to build similar functionality elsewhere

Violation of these terms may result in immediate termination, civil liability up to $500,000 per violation, and criminal prosecution under the Computer Fraud and Abuse Act (18 U.S.C. Section 1030).

4. Non-Compete Acknowledgment

By using the Service, you acknowledge that our viral content optimization methodology represents substantial investment in research and development. You agree not to use insights, patterns, or methodologies observed from the Service to create, assist in creating, or advise on the creation of competing services for a period of 24 months following your last use of the Service.

5. Subscription Plans and Payment

The Service offers subscription plans:

  • Free: 3 generations per month
  • Pro ($29/month): 50 generations per month
  • Business ($99/month): Unlimited generations, team access

6. Monitoring and Enforcement

We actively monitor for unauthorized use, copying, and competitive intelligence gathering. Our systems include digital fingerprinting, usage pattern analysis, and automated detection of suspicious activity. We reserve the right to pursue all legal remedies against violators, including injunctive relief, damages, and attorney fees.

7. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in the federal or state courts located in Wilmington, Delaware. You consent to personal jurisdiction in these courts.

8. Injunctive Relief

You acknowledge that any breach of Sections 2, 3, or 4 would cause irreparable harm for which monetary damages would be inadequate. Therefore, we shall be entitled to seek immediate injunctive relief without the necessity of proving actual damages or posting bond.
